The Ethics Regulations in Key Alliance of Smart Nursing, Korean Academy of Smart Nursing

This regulation describes the ethical responsibilities and rights of nursing scholars in academic activities such as research performance, publication of results, and academic presentation, and is based on the ethical regulations of the Korean Society of Nursing Science. Members of Key Alliance of Smart Nursing, Korean Academy of Smart Nursing must comply with the following and comply with the results of deliberation by the ethics committee of the Key Alliance of Smart Nursing, Korean Academy of Smart Nursing.

Chapter I General Provisions

Article 1 (Purpose)

The purpose of this regulation is to prescribe matters concerning ethics related to academic activities, such as research, publication, and academic presentation enacted by Key Alliance of Smart Nursing, Korean Academy of Smart Nursing (hereinafter referred to as the society).

Article 2 (Subject and scope of application)

This regulation applies to members of the society and to businesses and businesses organized by the society.

Chapter 2 Research

Article 3 (Research conducted)

Members shall comply with ethical regulations in the process of planning and conducting research and shall not violate research ethics such as research irregularities or inappropriate research activities.

  1. Research misconduct refers to forgery, falsification, plagiarism, or unfair presentation of thesis authors conducted in the process of proposing, conducting research, reporting and reviewing research results.

    1. Forgery refers to the act of falsely creating data or research results that do not exist.
    2. Modulation refers to the act of distorting research contents or results by artificially manipulating research materials, equipment, processes, etc. or arbitrarily modifying or deleting data.
    3. Plagiarism refers to the use of other people's ideas, research results, etc. without appropriate citation.
    4. Unfair thesis author indication refers to the act of granting a thesis author qualification to a person who has made scientific and technical contributions or contributions to research contents or results without justifiable reasons.
  2. Research inappropriate behavior refers to the following.

    1. The act of condoning, abetting, or concealing an act of cheating
    2. Unjustifiable act in securing research data
    3. An act that is not justified in securing research data
    4. Performing and presenting two or more research tasks without approval with the same content of research
    5. Duplicate publication of papers of the same content in two or more academic journals in the same language or in different languages without a citation mark.
    6. The act of not revealing the source of the researcher's own past works, etc. while reusing them
    7. Making false statements about one's academic background, career, qualifications, research achievements, results, etc
    8. Intentionally obstructing the investigation into the alleged misconduct of the person or another person or causing harm to the informant
    9. Other acts recognized by the Ethics Committee as inappropriate
Article 4 (Research Aid)

In conducting research, members shall not infringe on the rights or personalities of research assistants, including researchers and graduate students participating in the study, and shall provide legitimate treatment according to their contribution.

Article 5 (Research subjects)
  1. The person who conducts research on humans has the following responsibilities for the subject.

    1. Ensures the voluntariness of the subject's participation in the study.
    2. Fully explain and obtain consent for the purpose and method of the study, the expected effects and potential risks and possible inconveniences, and the benefits and damages caused by participating in the study.
    3. Ensure the safety and health of the subject. Preventive measures are taken to prevent even minor damage to the subject, and if an unexpected risk occurs, the study is immediately stopped.
    4. If the subject of the study is a patient, information on the newly attempted nursing method is provided in the same way as the treatment group so that the patient in the control group does not suffer from information concealment or opportunity deprivation.
    5. Ensures the subject's freedom to stop participating in the middle.
    6. Respect the privacy of the subject and maintain personal secrets.
  2. When conducting research on humans, it is required to pass the institutional review committee. However, exceptions are made in the following cases.

    1. Research on animals (animal research must pass the Animal Institution Review Committee)
    2. A Study on Administration and System
    3. Research using secondary data such as meta-research
    4. Research unrelated to the deliberation of other institutional review committees
  3. To protect subjects who are dependent on researchers, such as patients/students, follow the following.

    1. If a patient or student refuses to participate in the study, it is stated that there is no disadvantage and measures are taken to protect them.
    2. If participation in the study is a essentials for the course or an opportunity to receive additional credits, other alternative activities are provided to the student so that the student can choose on his or her own.
Article 6 (Research Expenses)
  1. Members voluntarily sign research contracts and conduct research.
  2. Members shall execute research funds transparently and fairly in accordance with the provisions of the research fund management institution.
  3. When presenting research results that have benefited from research funds, members shall specify the supporting institution.

Chapter I General Provisions

Article 1 (Purpose)

The purpose of this regulation is to prescribe matters concerning the operation of the ethics committee (hereinafter referred to as the committee) established to help members of the society comply with research ethics pursuant to article 14 of the Key Alliance of Smart Nursing, Korean Academy of Smart Nursing (hereinafter referred to as the society).

Article 2 (Definition of Violation of Research Ethics)

Violations of research ethics prescribed in these regulations are as follows.

1. Research Fraud
  1. Forgery: the act of creating false data or research results that do not exist.
  2. Modulation: Distorting research contents or results by artificially manipulating research materials, equipment, processes, etc. or arbitrarily modifying or deleting data
  3. Plagiarism: the act of using other people's ideas, research results, etc. without appropriate citation.
  4. Indication of unjustified thesis author: the act of granting a thesis author qualification to a person who has made a scientific or technical contribution or contribution to a research content or result without justifiable reason, or to grant a thesis author qualification to a person who has not made a scientific or technical contribution or contribution
2. Inappropriate conduct of research
  1. Conceiving, abetting, or concealing misconduct
  2. Infringement of the rights and interests of the study subjects
  3. Acts without justification for securing research data
  4. Performing and presenting two or more research tasks without approval with the same content of research
  5. Duplicate publication of papers of the same content in two or more academic journals in the same language or in different languages without a citation mark
  6. The act of not revealing the source of the researcher's own past works, etc. while reusing them
  7. Making false statements about one's academic background, career, qualifications, research achievements, results, etc
  8. Intentionally obstructing the investigation into the alleged misconduct of the person or another person or causing harm to the informant
  9. Other acts approved by the ethics committee as inappropriate

Chapter II Committee

Article 3 (Composition of Committee)
  1. The Committee shall be comprised of not less than eight but not more than ten persons, including the chairman of the ethics committee (hereinafter referred to as the "chairman").
  2. Ethics members (hereinafter referred to as "members") shall be comprised of not more than two external experts appointed by the executive director of the Key Alliance of Smart Nursing, Korean Academy of Smart Nursing Association and the president.
  3. The chairman of the ethics committee shall be the president of the society, and the ethics director shall concurrently serve as the legislative director and oversee ethics-related affairs.
  4. In principle, the term of office of the chairman and members shall be two years.
Article 4 (Operation of Committee)
  1. The Committee shall convene at the request of the chairman or at least 1/4 of the incumbent members.
  2. The Committee shall be established with the attendance of a majority of its members, and a resolution shall be made with the consent of a majority of the number of members present. However, the power of attorney shall be recognized as attendance at the convening of the committee, but voting rights shall not be granted.
  3. The chairman shall be deemed to have been rejected if he/she has no voting rights and is a tie.
Article 5 (Duties of the Committee)
  1. The Committee shall perform the following duties to achieve the purpose under
Article 1
  1. Raising members' awareness of research ethics
  2. Deliberation and handling of member's violation of research ethics
  3. Review and revise ethics regulations and ethics committee regulations
  4. Other duties imposed on the committee

Chapter 3 Protection of Informants, etc. of Research Violations

Article 6 (Protecting the rights of informants)
  1. A member of an academic society or an academic society shall prepare and submit an application for deliberation in the real name along with data on the details of the application for deliberation to the academic society. However, even if it is an anonymous tip-off, if evidence containing the name of the research project, the name of the paper, and specific research misconduct is received in writing, it may be processed in accordance with the real-name tip-off.
  2. Matters concerning the identity of the informant shall not be subject to information disclosure and shall be protected from being disadvantaged for the reasons of the informant.
  3. The informant may request the society to inform the procedure, schedule, etc. conducted after reporting the violation of research, and the society shall faithfully comply with such request.
Article 7 (Protection of the rights of the subject)
  1. The Committee shall take care not to infringe on the honor or rights of the subject during the verification process.
  2. Suspicions of research violations should not be disclosed to the outside until the judgment is made. Provided, That this shall not apply when necessary measures are to be taken due to the occurrence of matters referred to in each subparagraph of paragraph of manufacturing.
  3. The respondent may request the academic society to inform the procedure, schedule, etc. for deliberation on the violation of research, and the academic society shall faithfully comply with such request.

Chapter 4 Deliberation on Research Violations

Article 8 (Procedure for Deliberation)
  1. When deliberating on research violations, it goes through the procedures of "preliminary investigation," "main investigation," and "judgment."
  2. When the chairman is aware of sufficient allegations of research misconduct, he/she may immediately initiate the main investigation without going through the preliminary investigation procedure.
Article 9 (Preliminary Investigation)
  1. A preliminary investigation is a procedure for determining whether to conduct the main investigation on allegations of research violations, and shall be initiated within 30 days from the date of receipt of the report. The form of the preliminary investigation body shall be determined autonomously by the chairman.
  2. If necessary during the preliminary investigation process, the informant and the investigated person may be given an opportunity to state their opinions.
  3. The Committee may immediately make a judgment without going through the main investigation when the investigator has acknowledged all of the violations of the research.
  4. The president of the association shall notify the informant and the respondent of the results of the preliminary investigation in writing within 10 days from the date of the completion of the preliminary investigation, and where he/she decides not to conduct the investigation, he/she shall include specific reasons therefor. However, this is not the case in the case of anonymous reports.
Article 10 (Main Survey)
  1. This investigation is conducted by requesting an external specialized institution as a procedure to prove whether a violation of research is true.
  2. The external specialized agency conducting this investigation shall give the informant and the investigated person an opportunity to state their opinions, etc., and if the party does not comply, it shall be deemed that there is no objection.
Article 11 (Exclusion, avoidance, avoidance, etc. of investigators)
  1. In any of the following cases, it shall be excluded from the investigator in the relevant case.

    1. A person who has or had a relative relationship with the informant or the investigated person
    2. A person who has been in a relationship with the informant or the investigator or has conducted research jointly
    3. Other persons deemed likely to harm the fairness of the investigation
  2. Where an investigator has an interest in the task to be investigated, he/she shall file an application for avoidance on his/her own.
Article 12 (Authority of Committee)
  1. The Committee and external specialized institutions may request informants, investigators, witnesses and witnesses to attend for statements during the deliberation process, and in such cases, the investigator shall comply with such request.
  2. The Committee and external specialized institutions may request the subject to submit data.
  3. The Committee and external specialized institutions may propose appropriate sanctions to the head of the relevant institution for those related to research violations.
Article 13 (Determination)
  1. Judgment refers to the fact that the head of the society notifies the informant and the investigated person of the results of the deliberation and investigation in writing.
  2. All investigations from the start of the preliminary investigation to the judgment shall be completed within six months. Provided, That if it is deemed difficult to conduct an investigation within this period, the grounds therefor may be notified to the informant and the investigated person and the period of deliberation may be extended.
Article 14 (Application for Objection, etc.)
  1. Where there is an objection to the results of the preliminary investigation or the results of the judgment, the informant or the respondent may file an objection in writing with the committee within 30 days from the date of notification of the results. The committee shall process an objection under paragraph (1) within 60 days from the date on which the objection is received, except in extenuating circumstances.

Chapter 5 Follow-up Measures for Deliberation Results

Article 15 (Notification of the results of deliberation)
  1. The minutes of the committee shall be kept as records, and shall be verified, signed, and sealed by the chairman.
  2. The committee and external specialized institutions shall report the results of deliberation to the president of the Korean Senior Nursing School.
  3. The president of the association shall notify the informant and the investigated person of the results of deliberation by the committee and external specialized institutions in writing. Provided, That this shall not apply to anonymous information.
  4. The results of deliberation shall not be published before the president of the society decides.
Article 16 (Follow-up measures for research violations)
  1. If it is determined as a violation of research as a result of deliberation, the committee may decide on measures falling under each of the following paragraphs alone or in combination. However, follow-up measures as a result of deliberation shall be taken by the president of the society after the objection is completed.

    1. If it is simply due to misunderstanding of the principles, a letter of explanation containing educational content will be sent
    2. Send a letter of reprimand and a letter of warning about future misconduct
    3. Send an official letter to the head of the affiliated agency or research fund support agency
    4. Publishing a notice about duplicate publications or plagiarism
    5. Publishing the editor's article on the full extent of cheating
    6. Prohibition of manuscript submission for a certain period of time to individuals, units, and institutions responsible for fraud
    7. Notification of the official withdrawal or cancellation of the paper from the journal to other academic journal editors and indexing agencies
    8. Report to an institution that can investigate and take action in accordance with due process
    9. Suspension of qualification for not more than 3 years
  2. The cancellation notice of papers published in academic journals shall be in the same form as general papers, and thesis cancellation articles shall be listed in the journal table of contents like general papers so that they are not excluded from the scope of the index.
  3. The term "suspension of membership qualification" under paragraph (1) 9 means restrictions on the following matters.

    1. Publication of papers in academic journals
    2. Participation in academic activities
    3. Ex officio and citation of thesis
    4. Other rights as a member
Article 17 (Cost Burden)

The Committee may have a person who has received follow-up measures bear all or part of the expenses used for deliberation.

Article 18 (Period calculation)

The period of suspension of membership rights shall be calculated from the date when it becomes effective by a resolution of the ethics committee.

Article 19 (Effect of Decision)

Matters to be deliberated shall take effect by the publication of the president of the society.

Article 20 (Whether the meeting is open or not)
  1. Meetings are not open to the public. Provided, That if deemed necessary, it may be disclosed by a resolution of the committee.
  2. No member, etc. shall divulge facts recognized in connection with his/her duties without justifiable grounds.
  3. Members, etc. shall not be held liable outside the committee for remarks and votes made in the course of their duties.

Chapter 6 Auxiliary Provisions

Article 21 (Amendment of regulations)

Amendments and revisions to these regulations shall be made with the approval of a majority of the board of directors.

Article 22 (Governing Regulations)

Guidelines related to research violations not described in this regulation follow the research ethics guidelines of the Ministry of Education, Science and Technology.

Chapter VII Supplementary Provisions

Article 23 (Effective Date)

These regulations shall come into force on the date of approval by the board of directors.
